Terms of Service

By creating an account, downloading the app, or otherwise accessing the Service, you represent that you are at least 13 years of age (or 16 in certain jurisdictions), have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and our Privacy Policy.

BodyScan AI is a mobile application that uses artificial intelligence to estimate body composition metrics — including body fat percentage, lean muscle mass, BMI, body water percentage, visceral fat, metabolic age, and bone mass — from photos submitted by users.

Medical Disclaimer: BodyScan AI is a wellness and fitness tracking tool, not a medical device. Results are estimates for informational purposes only and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional before making health or fitness decisions.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and account credentials.
• Notify us immediately of any unauthorized access to or use of your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or are inactive for an extended period.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the app on iOS devices that you own or control, solely for your personal, non-commercial purposes.

You agree not to:

• Copy, modify, distribute, or create derivative works based on the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service for any commercial purpose or for any public display without our prior written consent.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Use automated bots, scrapers, or other tools to access the Service.
• Violate any applicable law, regulation, or third-party rights.

When you submit photos or other content ("User Content") to the Service, you grant us a limited, worldwide, royalty-free license to use, process, and store your User Content solely for the purpose of providing the Service to you. You retain ownership of your User Content.

You represent and warrant that:

• You have the right to submit the User Content.
• The User Content does not violate any third-party rights or applicable laws.
• You will only submit photos of yourself or individuals for whom you have explicit consent.

Body composition results provided by BodyScan AI are algorithmic estimates based on photo analysis and user-provided profile data. These estimates:

• May not reflect clinically accurate measurements.
• Are subject to variations based on photo quality, lighting, clothing, and other environmental factors.
• Should not be used as the sole basis for medical, dietary, or fitness decisions.

We do not warrant that the results will be error-free or suitable for any particular purpose.

The Service, including all content, features, functionality, software, text, graphics, logos, and trademarks (excluding User Content), is owned by BodyScan AI and is protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or trade dress without our prior written consent.

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of your information as described in the Privacy Policy.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not warrant the accuracy, completeness, or usefulness of any body composition estimates generated by the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BODYSCAN AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50.00 USD.

You agree to indemnify, defend, and hold harmless BodyScan AI and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. You may terminate your account at any time by deleting it through the app (Profile → Delete Account) or by contacting us at support@bodyscanai.app.

Upon termination, your license to use the Service will immediately cease. Sections 7, 8, 10, 11, 12, and 15 of these Terms will survive termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing notice through the app or via email. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising under these Terms shall first be addressed informally by contacting us at support@bodyscanai.app. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

The following additional terms apply to your use of the iOS application, as required by Apple:

• These Terms are between you and BodyScan AI only, and not with Apple, Inc. ("Apple"). Apple is not responsible for the app or its content.
• The license granted is a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules.
• Apple has no obligation to provide any maintenance, support services, or warranty for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or any third party relating to the app or your use of the app, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• In the event of a third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, BodyScan AI (not Apple) will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
